Victim of Cyber Crime in India? Here's What to Do — Your Rights Under the IT Act Explained

It happens in seconds. A phone call from someone pretending to be your bank. A link in a WhatsApp message that steals your password. Money transferred out of your account without your knowledge. Or someone misusing your photos online.
Cyber crime in India is rising sharply — and most victims do not know what to do in the first critical hours. This guide, written from a cyber law consultation perspective, explains exactly what your rights are, what steps to take immediately, and how the legal process works in India.
⚖️ What Law Protects You in India?
India's primary law governing cyber crime is the Information Technology Act, 2000 (IT Act), along with its 2008 amendments. This law covers a wide range of digital offences and gives victims clear legal remedies.
Here are the key sections that protect you:
📌 Section 43 — Unauthorised access to a computer or network. Covers hacking, data theft, and system damage.
📌 Section 66 — Computer related offences. Criminal punishment for hacking, identity theft, and data fraud.
📌 Section 66C — Identity theft. Using someone else's password, digital signature or other identity information.
📌 Section 66D — Cheating by impersonation using a computer. Covers fake profiles, fake calls, and phishing.
📌 Section 67 — Publishing obscene material online. Covers misuse of private images and videos.
📌 Section 72 — Breach of confidentiality and privacy. Covers unauthorised disclosure of personal data.
🚨 Step 1 — Do These Things Within the First 24 Hours
The first 24 hours after a cyber crime are the most critical. Evidence can be deleted, money can be transferred further, and accounts can be wiped. Here is exactly what to do:
🟡 If money was fraudulently transferred from your account:
Call your bank's fraud helpline immediately and ask them to freeze or flag the transaction
Call the National Cyber Crime Helpline: 1930 — this is a dedicated line for financial cyber fraud and can help freeze the recipient account
Take screenshots of all transactions, messages, and call logs immediately — before they disappear
🟡 If you are a victim of hacking, harassment, or identity theft:
Screenshot everything — the fake profile, the messages, the posts, the emails. Timestamp matters.
Do NOT delete messages or block the attacker yet — that deletes evidence
Change your passwords on all accounts immediately from a clean, unaffected device
Enable two-factor authentication wherever possible

📝 Step 2 — File a Complaint Online (Cyber Crime Portal)
India has a dedicated national portal for cyber crime complaints: cybercrime.gov.in. You do not need to visit a police station to file an initial complaint — you can do it entirely online, from your home.
Here is what the portal covers:
✅ Online financial fraud (UPI fraud, banking fraud, credit card fraud)
✅ Social media crimes (fake profiles, harassment, defamation)
✅ Email and phishing fraud
✅ Ransomware, hacking, and data theft
✅ Online obscene content and non-consensual image sharing
⚠️ Important tip: When filing your complaint, attach every screenshot you have taken. The more evidence you provide at the time of filing, the stronger your case. Do not rely on memory — attach documents.
🏛️ Step 3 — Register an FIR at Your Local Police Station
An online complaint on the cyber crime portal is the first step — but for serious offences, you will also need to file a First Information Report (FIR) at your local police station or the nearest Cyber Crime Cell.
Mumbai has dedicated Cyber Crime Cells across the city. When you go to file an FIR, carry:
Printed screenshots of all evidence — messages, transactions, profiles
Your bank statement showing the fraudulent transaction (if financial fraud)
A written timeline of events — what happened, when, and how
Your photo ID and address proof
Your acknowledgement number from the cybercrime.gov.in complaint (if already filed)
🟡 If the police refuse to register your FIR, you have the right to approach the Superintendent of Police or file a complaint directly with the Magistrate under Section 156(3) of CrPC.
